Store regulations
1. General Provisions
1.1. Online store operating at: http://www.lesens.pl/ as part of the business activity under the name: "LESENS POLSKA" address: Oficerska 43, 42-202 Częstochowa NIP: 573-232-53-94 entered into the Central Register of Business Activity kept by the Minister of Economy (www.firma.gov.pl).
1.2. These Regulations define the rules for placing orders and concluding and terminating sales agreements regarding products offered through the online store at: http://www.lesens.pl/ hereinafter referred to as: http://www.lesens.pl, as well as the rules for performing these agreements, the rights and obligations of the http://www.lesens.pl store and the Customer, and the rules for handling complaints and protecting personal data.
1.3. Customers may at any time obtain free access to these Regulations on the website http://www.lesens.pl or print them out.
1.4. Agreements concluded via the online store http://www.lesens.pl are concluded in Polish.
1.5. All announcements, advertisements, price lists and other information posted on the website http://www.lesens.pl do not constitute an offer within the meaning of the provisions of the Civil Code, but an invitation to conclude an agreement (Article 71 of the Civil Code).
2. Procedure for concluding an agreement / order fulfillment
2.1. http://www.lesens.pl accepts orders via the website http://www.lesens.pl
2.2. Orders can be placed 24 hours a day, 7 days a week.
2.3. Placing an order means selecting the type and number of products on the website http://www.lesens.pl, clicking the add to cart icon, filling out the order form, selecting the payment and delivery method, and then confirming the order.
2.4. The ordering procedure involves reading and accepting these Regulations, which the Customer confirms by checking the appropriate box before finalizing the order. Failure to accept these Regulations during the ordering procedure prevents the possibility of purchasing goods via the online store http://www.lesens.pl and requires the agreement of the terms of the transaction in another form.
2.5. Placing an order by the Customer constitutes an offer to conclude a sales agreement for products that are the subject of the order within the meaning of art. 66 § 1 of the Civil Code.
2.6. The person placing the order is obliged to fully and accurately complete the data required in the order form available on the website http://www.lesens.pl, and in particular to provide the name, surname and address. Providing incomplete, false or incorrect data may make it difficult or even impossible to complete the order. Please provide a correct telephone number, which will facilitate contact in the event of any problems with the order.
2.7. After the Customer places a correctly completed order, they will receive a response from the online store http://www.lesens.pl confirming acceptance of the order. Confirmation of acceptance of the order is a statement from http://www.lesens.pl about the acceptance of the offer and at that moment a sales agreement is concluded.
2.8. The order processing time is from 1 to 14 business days, counting from the day the Customer places the order.
3. Prices and payment
3.1. The prices of products presented on the website of the store http://www.lesens.pl are gross prices (i.e. they include VAT tax) and are expressed in Polish zloty or Euro.
3.2. The prices of goods given on the websites do not include delivery costs. The delivery cost depends on the delivery method selected when placing the order and is visible before finalizing the order and accepting the regulations.
3.3. The total cost of the order, including the price of the product and the delivery cost, is visible in the summary of the order.
3.4. The binding and final price is the price of the product given on the store website http://www.lesens.pl at the time of placing the order by the Customer.
3.5. Payment for the ordered goods can be made in the forms available during the order execution before its finalization, the forms of payment may depend on the selected form of delivery.
3.6. Cash register receipts or VAT invoices are issued for all goods ordered in the online store http://www.lesens.pl.
4. Delivery
4.1. The ordered products are delivered via a courier company or by the Customer's own transport http://www.lesens.pl, according to the Customer's choice made when placing the order.
4.2. The ordered goods are delivered - depending on the Customer's choice - directly to the Customer's address indicated in the order form or collected in person at the personal collection point at the address provided during the execution of the order.
4.3. In the case of placing an order covering several products, the cost of delivery is calculated for one product, according to the higher value.
4.4. Upon receipt of the shipment, the Customer should, if possible, check the package and the received product in the presence of the delivery person for any damage. It is advisable that in the event of damage to the shipment or goods, the Customer, if possible, refuses to accept the shipment and, in the presence of the courier, confirms the condition of the shipment in a protocol, which will significantly facilitate the pursuit of claims.
4.5. By accepting these Regulations, the Customer grants the owner of http://www.lesens.pl, referred to in point 1.1 of the Regulations, a power of attorney to conclude a one-time agreement on his behalf with a courier company to send a parcel ordered at http://www.lesens.pl at his expense (this does not apply to delivery by own transport http://www.lesens.pl). The power of attorney allows for minimizing the price of the parcel and does not additionally burden the buyer in any way. With such a power of attorney, the amount of the courier fee will not be included on the receipt or VAT invoice. The costs of the goods, packaging and preparation for shipment will be included there. The Seller does not provide the Customer with a transport service - he does not gain any profit from it. If the Customer does not agree to grant such a power of attorney, he should notify http://www.lesens.pl by e-mail before placing the order. In such a situation, the cost of the parcel will be increased by VAT at the rate of 23%.
5. Consumer complaints
5.1. Consumers may file complaints about products purchased at http://www.lesens.pl in accordance with the provisions of the Act of 27 July 2002 on specific terms of consumer sales and on amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176)
5.2. http://www.lesens.pl is liable to the Customer, who is a consumer, if the consumer goods at the time of their delivery were inconsistent with the contract. However, http://www.lesens.pl is not liable for the non-conformity of the consumer goods with the contract, if the buyer knew about this non-conformity at the time of conclusion of the contract or, judging reasonably, should have known.
5.3. http://www.lesens.pl is liable for the non-conformity of the consumer goods with the contract in the event of its discovery before the expiry of two years from the delivery of the goods to the Buyer, and in the event of the exchange of the goods this period starts again.
5.4. The Buyer loses the above-mentioned rights if, within two months from the date of finding the non-conformity of the goods with the contract, he/she does not notify the Seller of the non-conformity. To meet the deadline, it is sufficient to send a notification before its expiry.
5.5. In the event of finding the non-conformity of the goods with the contract, the Customer may demand that the goods be brought into a condition consistent with the contract by free repair or replacement with a new one. However, if repair or replacement are impossible or require excessive costs, or if the seller fails to satisfy such a request in an appropriate time or if repair or replacement would expose the buyer to significant inconvenience, he/she has the right to demand an appropriate reduction in the price or withdraw from the contract; the contract cannot be withdrawn from if the non-conformity of the consumer goods with the contract is immaterial.
5.6. The complaint should include the Customer's data, order number, information on the type of defects found, the Customer's request and confirmation of purchase of the complained goods in the store http://www.lesens.pl.
5.7. The product complained about should be delivered – at the Customer's discretion – by post to the following address: Oficerska 43, 42-202 Częstochowa.
5.8. http://www.lesens.pl will respond to the Customer's complaint within 14 days. If the Customer's complaint is accepted, http://www.lesens.pl will repair or replace the product complained about with a full-value product or, if the replacement is not possible, will refund the Customer for the product complained about immediately, no later than within 14 days from the date of considering the complaint.
5.9. In the case of a complaint submitted by an entity that is not a consumer, the provisions of the Civil Code shall apply, in particular on warranty for defects.
6. Exchange
6.1. The customer has the right to exchange the purchased product for any other product from the offer of http://www.lesens.pl at the same or higher price, if the request for exchange is submitted no later than 14 days from the date of issue/delivery of the goods.
6.2. In order to make an exchange, it is necessary to inform http://www.lesens.pl about the intention to make an exchange by e-mail, and then return the goods by post to the following address: Oficerska 43, 42-202 Częstochowa, or deliver them in person to one of the collection points referred to in point 4.2. of the Regulations.
6.3. When making an exchange, it is necessary to provide the customer's data, order number, types of products to be exchanged and provide confirmation of purchase of the exchanged goods in the http://www.lesens.pl store. In order to facilitate the exchange, an exchange form has been made available on the http://www.lesens.pl website.
6.4. The exchange of goods is possible in the event of returning the purchased goods in the condition in which they were issued to the Customer, suitable for further sale, i.e. in the original packaging, without damage and traces of use.
6.5. The above provisions regarding the exchange of goods do not in any way limit the rights of the Customer, who is a consumer, to withdraw from the agreement, referred to in the further part of the Regulations.
7. Withdrawal from the agreement / return of goods
7.1. In accordance with the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws of 2000 No. 22, item 271), the Customer making a purchase as a consumer (i.e. as a natural person who acquires goods for purposes unrelated to business activity), who has concluded a distance contract via the online store http://www.lesens.pl, may withdraw from this contract without giving reasons, by submitting an appropriate written statement within 10 days from the date of issue of the goods constituting the subject of this contract. To meet this deadline, it is sufficient to send the appropriate declaration of the Customer to http://www.lesens.pl at the address: Oficerska 43, 42-202 Częstochowa, before the deadline.
7.2. The right to withdraw from a contract concluded remotely does not apply to the consumer in the cases provided for in art. 10 sec. 3 of the act mentioned above, and in particular in the cases of: concerning audio and visual recordings and recorded on computer data carriers after the consumer has removed their original packaging,
services with properties specified by the consumer in the order placed by him or closely related to his person,
services which, due to their nature, cannot be returned or whose subject is subject to rapid deterioration.
7.3. In the event of withdrawal from the contract, the contract is considered not concluded and the consumer is released from all obligations. What the parties have provided shall be returned in an unchanged state, unless the change was necessary within the limits of ordinary management. The return should take place immediately, no later than within fourteen days. If the consumer has made any prepayments, statutory interest is due from the date of the prepayment.
7.4. Returns of goods should be made to the following address: Lesens Polska department: lesens, Oficerska 43, 42-202 Częstochowa
7.5. The returned goods should be in an unchanged condition, unless the change was necessary within the limits of ordinary management. In particular, the Customer should return the goods in the condition in which they were issued (subject to the exception provided for in the preceding sentence), and together with the product return all received extras, freebies, instructions for use, etc.
7.6. The Buyer is obliged to properly secure the returned goods so as to prevent their damage during transport.
8. Personal data protection
8.1. http://www.lesens.pl undertakes to protect the personal data of its Customers in accordance with the Act of 29 August 1997. on the protection of personal data (consolidated text: Journal of Laws 2002, No. 101, item 926).
8.2. Providing personal data by the Customer is voluntary, however, failure to consent to the processing of personal data for the purposes of placing and executing an order prevents placing orders in the online store http://www.lesens.pl
8.3. The Customer confirms the consent to the processing of personal data by selecting the appropriate option during the ordering procedure.
8.4. Personal data provided by the Customer are collected, processed and used solely for the purpose of executing and settling orders and - if the Customer agrees to this in the manner specified in the previous point - informing about the products offered by http://www.lesens.pl.
8.5. The administrator of the Customers' personal data is "Lesens Polska", with its registered office at Oficerska 43, 42-202 Częstochowa, NIP: 573-232-53-94.
8.6. Customers have the right to request the completion, updating, correction of personal data, temporary or permanent suspension of their processing or their removal.
8.7. Detailed principles of data processing
9. Final provisions
9.1. In matters not regulated by these Regulations, the provisions of the Civil Code and the provisions of specific acts shall apply, including the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws of 2000, No. 22, item 271, as amended), the Act of 27 July 2002 on specific conditions of consumer sale and on amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended) and the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002, No. 133, item 926, as amended).
9.2. These regulations may be amended, in particular if it is necessary to adapt them to changes in the provisions of generally applicable law. The change of the regulations becomes effective on the date indicated by http://www.lesens.pl, no shorter than 14 days from the moment of making the new Regulations available on the website http://www.lesens.pl. The change of the Regulations does not violate the acquired rights of Customers. Orders placed by Customers are fulfilled according to the provisions of the Regulations in force on the day they were placed.
The Regulations are in force from 11 March 2013.
