• Store Terms and Conditions

These Terms and Conditions define the rules for using the Lesens online store, placing and processing orders, concluding sales agreements, making payments, delivery, personal collection, complaints and withdrawal from the agreement, as well as the rights and obligations of Customers.

1. General Provisions

1.1. The Lesens online store is operated by LESENS POLSKA, ul. Oficerska 43, 42-202 Częstochowa, Poland, Tax Identification Number (NIP): 5732325394, REGON: 240871312, e-mail address: biuro@lesens.pl, telephone: +48 34 365 79 73.

1.2. These Terms and Conditions define the rules for using the Lesens online store, placing and processing orders, concluding sales agreements, making payments, delivery, personal collection, complaints, withdrawal from an agreement, and the rights and obligations of Customers.

1.3. The Store sells products both to individuals and to businesses.

1.4. These Terms and Conditions are available free of charge on the Store website in a form that allows them to be saved, reproduced and printed.

1.5. Agreements concluded through the Store are concluded in Polish.

1.6. Information presented in the Store, including product descriptions, photographs, prices and availability, constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Polish Civil Code, unless the content of the relevant information provides otherwise.

2. Definitions

2.1. Store – the Lesens online store operated by the Seller.

2.2. Seller – LESENS POLSKA, ul. Oficerska 43, 42-202 Częstochowa, Poland.

2.3. Customer – a natural person, legal entity or organizational unit with legal capacity that makes a purchase through the Store.

2.4. Consumer – a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.

2.5. Entrepreneur with Consumer Rights – a natural person entering into an agreement with the Seller directly related to their business activity, where the agreement does not have a professional character for that person, resulting in particular from the subject of their business activity.

2.6. Entrepreneur – a Customer making a purchase in connection with their business or professional activity who is not entitled to the consumer protections referred to above.

2.7. Goods / Product – a product presented in the Store that may be the subject of a sales agreement.

2.8. Order – a declaration made by the Customer directly aimed at concluding a sales agreement for selected Goods.

3. Rules for Using the Store

3.1. The Customer is required to use the Store in accordance with applicable law, these Terms and Conditions and generally accepted standards of conduct.

3.2. The Customer is required to provide accurate information that enables the Order to be processed correctly.

3.3. The Seller shall not be liable for the inability to process an Order resulting from incorrect or incomplete information provided by the Customer if such information prevents proper processing of the Order.

3.4. Proper use of the Store requires a device with Internet access and an up-to-date web browser.

4. Placing and Processing Orders

4.1. Orders may be placed through the Store 24 hours a day, 7 days a week, subject to technical interruptions or other circumstances beyond the Seller's control.

4.2. To place an Order, the Customer selects the Goods and their quantity, delivery method and payment method, and provides the information necessary to process the Order.

4.3. Before placing an Order, the Customer is informed of the price of the Goods, delivery costs and the total value of the Order.

4.4. Placing an Order by the Customer constitutes an offer to conclude a sales agreement on the terms specified in the Order.

4.5. After an Order has been placed, the Seller sends the Customer confirmation that the Order has been received.

4.6. The sales agreement is concluded when the Seller confirms that the Order has been accepted for processing, unless applicable law or individual arrangements between the parties provide otherwise.

4.7. If it becomes impossible to process an Order, in particular due to the unavailability of Goods, the Seller shall inform the Customer and, if payment has already been made, refund the funds received in respect of the unfulfilled part of the Order.

4.8. The standard processing time for an Order is between 1 and 14 business days, unless a different period is specified for a particular Product or during the ordering process.

4.9. If Goods included in an Order have different availability dates, the Seller may contact the Customer to agree on the method of processing the Order.

5. Prices and Payments

5.1. Prices of Goods displayed in the Store are gross prices, unless expressly stated otherwise.

5.2. Prices are stated in the currency indicated in the Store.

5.3. Delivery costs are not included in the price of the Goods unless the information concerning a particular Product or Order states otherwise.

5.4. Delivery costs are presented to the Customer before the final submission of the Order.

5.5. The total value of the Order, including the price of the Goods and delivery costs, is presented before the agreement is concluded.

5.6. The Customer may make payment using the payment methods available during the ordering process.

5.7. The availability of individual payment methods may depend on the selected delivery method, Order value or other conditions specified during the ordering process.

5.8. For purchased Goods, the Seller issues the appropriate sales document, in particular a fiscal receipt or VAT invoice, in accordance with applicable law.

6. Delivery and Personal Collection

6.1. Goods may be delivered by a courier company, carrier or by the Seller's own transport, in accordance with the delivery methods available when placing the Order.

6.2. Delivery is made to the address provided by the Customer when placing the Order.

6.3. The Customer may also choose personal collection if this option is available for the relevant Order.

6.5. Before collecting an Order in person, the Customer should make sure that the Order is ready for collection.

6.6. In the case of delivery, the Customer should, where possible, check the condition of the shipment upon receipt.

6.7. Any damage to the shipment occurring during transport should, where possible, be documented, in particular by taking photographs and, where possible, preparing a damage report with the carrier.

6.8. Failure to prepare a damage report does not limit the Customer's rights arising from the Seller's statutory liability for the conformity of the Goods with the agreement.

7. Right of Withdrawal

7.1. A Consumer and an Entrepreneur with Consumer Rights who has concluded a distance agreement with the Seller may withdraw from the agreement without giving any reason within 14 days, subject to the exceptions provided by law.

7.2. In the case of a sales agreement concerning a single Product, the 14-day period begins on the day on which the Consumer or a person indicated by them takes possession of the Product.

7.3. If the agreement concerns multiple Products delivered separately, in batches or in parts, the period begins on the day on which the Consumer takes possession of the last Product, batch or part.

7.4. To meet the deadline, it is sufficient to send the withdrawal statement before the expiry of the 14-day period.

7.5. The withdrawal statement may be submitted in any form that clearly expresses the Customer's intention to withdraw from the agreement. For evidentiary purposes, written or electronic submission is recommended.

7.7. In the event of withdrawal from the agreement, the agreement shall be considered not concluded.

7.8. The Seller shall reimburse the Consumer for all payments made, including delivery costs, subject to the condition that the reimbursement of delivery costs covers the cheapest standard delivery method available in the Store. If the Consumer selected a more expensive delivery method, the Seller is not obliged to reimburse the difference between the selected method and the cheapest available method.

7.9. The refund shall be made without undue delay and no later than 14 days from the date on which the Seller receives the withdrawal statement.

7.10. The Seller may withhold the refund until the returned Product has been received or the Customer provides proof of its return, whichever occurs first.

7.11. Refunds shall be made using the same payment method used by the Customer, unless the Customer expressly agrees to another solution that does not involve additional costs.

7.12. The Consumer should return the Product without undue delay and no later than 14 days from the date on which they withdrew from the agreement.

7.13. The direct cost of returning the Product shall be borne by the Consumer unless the Seller has agreed to bear it or has failed to inform the Consumer of the obligation to bear this cost.

7.14. The Consumer shall be liable for any reduction in the value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.

8. Exclusions from the Right of Withdrawal

8.1. The right of withdrawal does not apply in cases specified by applicable law.

8.2. In particular, the right of withdrawal may not apply to Goods:

a) made according to the Consumer's specifications or clearly personalized for their needs,

b) liable to deteriorate or expire rapidly,

c) delivered in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons,

d) which, after delivery, due to their nature, become inseparably combined with other items,

e) consisting of sealed audio or video recordings or computer software where the seal has been removed after delivery,

f) other Goods for which applicable law provides an exclusion of the right of withdrawal.

8.3. If the right of withdrawal is excluded or limited in relation to a particular Product, the relevant information will be provided to the Customer before the agreement is concluded.

9. Complaints – Non-Conformity of Goods with the Agreement

9.1. The Seller is obliged to provide the Consumer and the Entrepreneur with Consumer Rights with Goods that comply with the agreement.

9.2. If the Goods do not comply with the agreement, the Consumer and the Entrepreneur with Consumer Rights may submit a complaint in accordance with applicable law.

9.3. Depending on the circumstances and applicable law, as part of a complaint the Customer may request that the Goods be brought into conformity with the agreement by repair or replacement, or, in cases provided by law, request a price reduction or withdraw from the agreement.

9.4. A complaint may be submitted:

9.5. The complaint should preferably include the Order number, Customer details, a description of the problem and the Customer's request.

9.6. Failure to provide all information shall not constitute grounds for refusing to accept a complaint if the complaint submitted allows it to be examined.

9.7. The Seller shall respond to a complaint submitted by a Consumer or an Entrepreneur with Consumer Rights within 14 days of receiving it where such a deadline is provided by law. Failure to respond within the required period shall mean that the complaint is deemed accepted in cases specified by law.

9.8. If a complaint is accepted, the Seller shall bear the costs associated with bringing the Goods into conformity with the agreement to the extent required by applicable law.

10. Complaints from Entrepreneurs

10.1. Customers who are Entrepreneurs and do not have the status of an Entrepreneur with Consumer Rights are subject to the provisions of the Polish Civil Code and other applicable laws.

10.2. In the case of Entrepreneurs, the Seller's liability may be modified to the extent permitted by applicable law.

10.3. An Entrepreneur may submit a complaint in particular by e-mail to biuro@lesens.pl or in writing to the Seller's address.

10.4. The complaint should contain information enabling identification of the Order and a description of the identified problem.

11. Voluntary Product Exchange

11.1. Regardless of the statutory right of a Consumer or an Entrepreneur with Consumer Rights to withdraw from an agreement, the Seller may allow a purchased Product to be exchanged for another Product available in the Store.

11.2. An exchange may be carried out after prior contact with the Seller and agreement on the relevant details.

11.3. A Product intended for voluntary exchange should be complete, undamaged and, to the extent permitted by law, in a condition allowing it to be resold.

11.4. The voluntary exchange procedure does not limit or exclude the statutory rights of a Consumer or an Entrepreneur with Consumer Rights, in particular the right of withdrawal and rights arising from non-conformity of the Goods with the agreement.

12. Personal Data

12.1. The Seller is the controller of Customers' personal data.

12.2. Personal data is processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

12.3. Detailed information concerning the processing of personal data, legal grounds for processing, data retention periods and Customer rights is provided in the Store's Privacy Policy.

12.4. Providing data required to process an Order is voluntary; however, failure to provide such data may make it impossible to conclude or perform the agreement.

12.5. Personal data may be transferred to entities involved in processing Orders, including payment operators, courier companies, IT service providers and accounting service providers, to the extent necessary to achieve the relevant purposes.

13. Reviews and Content Published by Customers

13.1. If the Store allows Customers to publish reviews concerning Products or services, Customers should publish lawful and truthful content.

13.2. It is prohibited to publish content that infringes the rights of third parties, personal rights, copyrights or other rights protected by law.

13.3. If the Store displays consumer reviews, information concerning the manner in which such reviews are obtained and verified is provided in accordance with applicable law.

14. Out-of-Court Dispute Resolution

14.1. Consumers may use out-of-court methods of complaint handling and pursuing claims provided for by applicable law.

14.2. In particular, a Consumer may seek assistance from a municipal or district consumer ombudsman or the relevant regional Trade Inspection authority.

14.3. Information concerning available out-of-court consumer dispute resolution methods may also be obtained from relevant consumer protection authorities.

14.4. Participation in out-of-court dispute resolution is voluntary unless applicable law requires participation in a specific procedure.

15. Liability and Provisions Concerning Entrepreneurs

15.1. The provisions of these Terms and Conditions are not intended to exclude or limit the rights of Consumers or Entrepreneurs with Consumer Rights arising from mandatory provisions of law.

15.2. If any provision of these Terms and Conditions is found to be invalid or ineffective, the remaining provisions shall remain in force and the relevant provision of law shall apply in place of the invalid provision.

15.3. In the case of Customers who are Entrepreneurs, to the extent permitted by applicable law, the Seller's liability may be limited in accordance with the agreement and the provisions of the Polish Civil Code.

16. Amendments to the Terms and Conditions

16.1. The Seller may amend these Terms and Conditions in particular in the event of:

a) changes in applicable law,

b) changes in the operation of the Store,

c) introduction of new payment or delivery methods,

d) the need to clarify provisions of the Terms and Conditions,

e) the need to correct errors or inaccuracies.

16.2. Customers will be informed of amendments to the Terms and Conditions by making the new version available in the Store.

16.3. Amendments to the Terms and Conditions shall not affect rights acquired by Customers before the amendment enters into force.

16.4. Orders placed before the new version of the Terms and Conditions enters into force shall be governed by the version applicable at the time the Order was placed, unless mandatory provisions of law provide otherwise.

17. Final Provisions

17.1. Matters not regulated by these Terms and Conditions shall be governed by Polish law, in particular the Polish Civil Code and the Act of 30 May 2014 on Consumer Rights.

17.2. In the case of Consumers and Entrepreneurs with Consumer Rights, the provisions of these Terms and Conditions shall be applied taking into account mandatory provisions of law protecting such entities.

17.3. These Terms and Conditions are effective from 18 August 2026.
